If you do not cooperate appropriately we cannot guarantee you receive the service for which you agreed to. We will always look for the most suitable resolution, in these instances.

If you wish to purchase from Checked Creative, you will be required to provide personal information such as your credit or debit card details, billing address, and shipping address.

By making a purchase, you represent and warrant that you have the legal right to use any payment methods associated with the transaction and that the information you provide is accurate, correct, and complete.

To facilitate payment and order fulfilment, we may use third-party services and share your information with them in accordance with our Privacy Policy.

We reserve the right to refuse or cancel your order for various reasons, including product or service unavailability, errors in the product or service description or price, mistakes in your order, or other factors. We may also refuse or cancel your order if we suspect fraudulent activity or an unlawful transaction.

Our product prices, including VAT, are subject to change at any time, and we may modify or discontinue any part of our service without notice at any time.

Waiver & Severability

The waiver by our company of any term or condition in the Terms will not imply a waiver of that term or condition or any other term. Failure to assert a right or provision under the Terms by our company will not constitute a waiver of that right or provision.

Content, distribution & violations

Checked Creative reserves the right to monitor and edit all user-submitted documents, but not the duty. Until payment is received, you may not use any of the produced documents for any reason.

You may not use the customized documents for any illegal or unauthorized purpose, and you may not violate any laws in your jurisdiction by using our products.

You are responsible for preserving any of your rights to any content or document you submit, post, or display publicly. We accept no responsibility and assume no liability for the document and content.

By using the generated documents on or through the service, you represent and warrant that: (i) the document or content is yours (you own and bought it), and you grant us the rights and licenses to use some of its aspects, and (ii) the posting of your content does not infringe on any person's or entity's privacy, publicity, copyrights, contract rights, or any other rights.

However, by using the document, you grant us the right and license to use, alter, publicly perform, display, reproduce, and distribute such document on our website and other related services, as we see fit.

We respect your personal data, and generally only reserve the right to use your company branding (logo) to display, as we wish, on our content, this would typically serve as an example of the type of projects our team have worked on in the past, or currently. We may choose to use your company logo in this manner, unless you specifically tell us not to do so. If this conflicts with your company branding policy it will be up to you, or your company, to inform us that you/they do not wish their logo is used, at which point we will of course remove any instances and use of the logo in question. We will not provide any of your personal data to any other third parties, unless in relation to performing our duties within the services you have agreed to, this includes your own company. We do not store such information, so will be unable to provide further information - even if requested to do so.

You represent and warrant that you own all rights, title, and interest in and to your User Content or that you have otherwise secured all necessary rights in your User Content as may be necessary to permit the access, use, and distribution thereof as contemplated by these Terms. As between you and Checked Creative, you own all right, title, and interest in and to your User Content. You grant Checked Creative a royalty-free and sublicensable license to display, host, copy, store and use your User Content solely to the extent necessary to provide the Service to you and others. You grant Checked Creative a perpetual, royalty-free, sublicensable, license to display, host, copy, store and use your Content to the extent necessary, as deemed by Checked Creative.

You agree to defend, indemnify and hold harmless Checked Creative and its affiliates, officers, directors, agents, licensors, partners, tools and employees from and against any and all claims, costs, damages, losses, liabilities and expenses (including reasonable attorneys’ fees and costs).

​

Checked shall not be liable for any delay or failure to perform any Services that is directly or indirectly caused by the Client’s failure to comply with its obligations.

Charges

The Client will pay for the Services during any permitted notice period. Should the Client fail to make any payment due under the terms of this Agreement by the due date, then Checked shall be entitled without prejudice to any other right or remedy to charge the Client interest on the amount outstanding on a daily basis at the rate of ten percent (10%) per annum, such interest to be calculated from the due date for payment thereof to the actual date of payment. Commission payments will continue to be due for payment beyond the end date of any Schedule, unless otherwise stated, this is indefinite. There is not a defined end date to this, however out of courtesy we typically limit these to 24 months after the last contracted date.

DATA PROTECTION ACT
Both Parties will comply with (and shall ensure that its staff and/or subcontractors comply) with, 25th May 2018, the General Data Protection Regulation 2016/679 (“GDPR”).

​

Checked reserves the right to use in any way it thinks fit any skills, ideas, knowledge and techniques acquired by Checked in performing the Services and is hereby granted and perpetual, irrevocable license to use.

​

If you find yourself unable to agree with or comply with any of the terms outlined in these agreements, please inform us by sending an email to support@checkedcreative.com. We will address your concerns and work with you to find a solution.

These terms apply to all individuals who visit, use, or access our service, including users, associates and other visitors.
